UPDATE 7/12/2024 - Boil Notice has been lifted

With the recent power issues from hurricane Beryl, the water pressure has dipped below safe drinking levels. The pressure is now back up, but to be safe please boil your water before drinking.

Todd Mission Parcel Data and Potential Improvements...

Posting this here, as it outlines what Todd Mission boundaries are if they assume the CCN (Utility rights, referenced below) from Mill Creek Water Supply and rebuild the water service for the area. In order for Todd Mission as a city to become a bonified utility provider they must obtain the CCN rights from MCWS to improve the water supply for the city. In the meeting there are a couple schools of thought regarding this... some positive, some negative. I am attaching the boundary defined by Todd Mission, as to what responsibility they will have, and why it may be of concern.

Potential positives brought up:

  • Todd Mission will have access to state grants and funding to make marked improvements on the water supply in a short time
  • Responsibility shifts to Todd Mission to maintain and care for the water supply
  • Potential improvements on quality of water through treatment, and pressure through larger pipes and better wells
  • With CCN from MCWS, Todd Mission will be considering city sewage and water treatment
  • Fire Hydrants being placed throughout neighborhoods
  • Regulated by TX on quality, pressure, depth and size of piping to keep from freezing crushing, contaminents etc

Potential Negatives brought up:

  • In giving up CCN rights to Todd Mission from MCWS, MCWS loses utility rights or has to split area, yet still has to maintain water, wells, distribution for areas outside of Todd Mission's Parcel
  • Mill Creek Estates will be split between whats inside of Todd Mission and whats outside of Todd Missions boundaries
  • The benefits of the improvements made will only be for residents inside Todd Mission, leaving MCWS and FloWatch to continue to maintain the rest without CCN utility rights
  • There is the possibility that Todd Mission will start a MUD (Municipality Utility district) for improvements as more housing is built. Could lead to an addl tax for new home owners.
  • Eminant domain - Todd Mission will then have rights to condem areas or throughfares for utility placement or improvements
  • City sewer, though nice... can create a smell around treatment plants that the area residents may not want to deal with
  • No incentives given to builders, potentially slowing or stalling new house builds due to having to deal with the city vs MCWS

Other notes taken during non-official water meeting:

  • What is a CCN?
    • A Certificate of Convenience and Necessity (CCN) gives a retail public utility the exclusive right to provide retail water or sewer utility service to an identified geographic area. The Texas Water Code and Public Utility Commission of Texas (PUCT) rules refer to this as the “certificated service area.” A CCN holder is required to provide continuous and adequate service to the area within its CCN boundary.

  • Question was asked about costs, and taxes potentially going up to support Todd Mission utilities if they owned the CCN... city representatives were witnessed stating that there is no tax for the utility improvements. They would not comment about the future potential taxation or the creation of MUD districts which would be an added tax based on district. The CCN area in itself does not allow taxation. 
  • Question was asked if Todd Mission could ensure no apartments would be built in the area they are proposing... city representation were witnessed taking this question as a joke as the "zoning" would not allow for it. The argument is "what" zoning, as most of the area less the HOA's are zoned unrestrictive. Zoning docturen's would need to be created if not already to restrict commercial living buildings in the areas supported by and in reach of the CCN if Todd Mission is controlling. 
  • There have been concerns with builders in the area, stating that they are worried about city hesitation, slowness, and potential lack of representation in the city to ensure projects continue without potentially sitting on builder loans for longer waiting for the city to make decisions. Would require posted and communciated city SLA's for approval, giving expected approval and completion times to ensure trust in city process. 
  • I am sure there were other items not captured here, but this covers some of the main points brought up. Ultimately there will need to be an official vote, which will transfer CCN ownership rights to the city of Todd Mission to build and manage the utilities for the attached area.

In accordance with Chapter 551 of the Texas Government Code, Vernon’s Annotated Civil Statutes, Section 31, notice is hereby given to the public that the MILL CREEK WATER SUPPLY CORPORATION shall hold a Special Membership meeting following the 12pm HOA meeting on the 18th of May 2024, at 11036 Oak Forest Dr, Plantersville, Texas, 77363. The Board may take action on any of the items posted below.  Action cannot be taken on individual citizen or customer communications or Board member items unless the matter was continued from a previous meeting or is individually listed below.  The Corporation provides unrestricted access for the disabled.

The Board of Directors may go into executive session pursuant to the Texas Open Meetings Act, codified as Texas Government Code, Chapter 551, Sections 551.071 551.072, 551.074 and/or 551.076 at any time during the meeting.

Item 1.  Open Meeting, Establish Quorum

Item 2.  Consideration of Todd Mission’s offer to purchase part of Mill Creek Water Supply Corporation’s public drinking water system facilities located within the boundaries of Todd Mission, TX, and possible partial acquisition of CCN service area rights.

Item 3. Exploration of potential membership in TRWA (Texas Rural Water Association).

Item 4. Exploration of expanding the board by at least 2 separate positions which would include amending the current by-laws to include but not be limited to secretary, a community liaison between the board, MCWS membership and Mill Creek HOA; and board member-at-large.

Item 5. Special Meeting of Directors, if needed.
